McConnelle v Consumers Energy Co., 2009 ACO #129
The Commission overturned the magistrate’s award of wage loss benefits despite the existence of a work-related injury. The claimant in this matter was injured at work but his treating physician allowed him to continue working. The plaintiff indicated that his co-workers assisted him and that the work continued to cause him pain. However, the reason the plaintiff stopped working was due to multiple DUI convictions that caused him to lose his license. The Commission stated that the plaintiff failed to prove that the cause of his wage loss was due to the work injury. Rather, the clear reason for the wage loss was the multiple DUI infractions.
