Clayton v Vickers, Mich Ct App (2009)
In an unpublished opinion, the Court of Appeals affirmed the Circuit Court’s order granting the defendant’s motion for summary disposition. The plaintiff in this matter filed a complaint in Circuit Court in an attempt to enforce a 1998 order from the Appellate Commission that awarded medical benefits to the plaintiff. The Court of Appeals held that, because the defendant was paying everything required under the order, Circuit Court was not the proper venue (i.e. there was no judgment that required renewal by the Circuit Court). They further held that, to the extent the defendant is not paying under the order, the administrative agency is the appropriate arena to make that determination.
