In recent years, the Centers for Medicare & Medicaid Services (CMS) has strengthened the enforcement of Social Security Administration laws regarding all workers’ compensation and liability settlements. Rather than permitting parties to a workers’ compensation settlement to effectively pass liability for post-settlement medical costs onto Medicare, CMS requires that a Medicare set-aside (MSA) allocation be completed.

Put another way, parties to a workers’ compensation settlement must consider Medicare’s future interests. At the same time, CMS continues to change the rules with regard to satisfying Medicare’s interests.
