Stokes’ Decision Regarding Disability, 2006
Court of Appeals


The Court of Appeals’ majority has held that plaintiff has the burden to establish a loss of earning capacity causally related to a work-related injury. The plaintiff must establish one’s qualifications’ training, and experience, and an inability to perform all jobs within that category. The employer is allowed to present evidence of transferable skills and utilize discovery methods such as interrogatories, vocational interviews, depositions, etc.
