Barcewski v Yellow Freight System, Inc, 2004
The Workers’ Compensation Appellate Commission found that when a hernia results from a single-event trauma, it is governed under the requirements of a compensable hernia under Chapter 3, not Chapter 4. Accordingly, the requirements under Chapter 4 that require a hernia be recent in origin and promptly reported are not applicable when a hernia is the result of a single-event trauma.
