The plaintiff in this case suffered a work-related injury, but returned to work in a regular job at an equal hourly rate. Plaintiff’s injury did however suffer wage loss because he was no longer capable of obtaining overtime. The Commission explained that the focus is not on the hourly rate, but the compensation as a whole. Accordingly, the claimant did establish a compensable disability because he was no longer able to work overtime.
