Floyd v Detroit Diesel Corp, 2004
With respect to the disability analysis required pursuant to Sington, the Appellate Commission again reiterated that if there is proof of a viable real job which the claimant is capable of performing, then he will not meet the “threshold” definition of disability. The claimant in Floyd was incapable of performing all jobs within his qualifications and training that paid at or above his maximum earning capacity, therefore disabled.
