A Representative Case
In a recently successful case, Raybon v. DP Fox Football Holdings, LLC, Grand Rapids Rampage, the attorneys at our firm argued in the Court of Appeals that even if a seasonal employee establishes an injury and disability during the course of his employment, he must further prove a wage loss related to the injury. In other words, just because the plaintiff in this case suffered a disabling injury during the football season and was not able to continue to play, he was not necessarily entitled to wage loss benefits during the off-season, when he would not have otherwise earned wages.
Although this case deals specifically with a seasonal minor league football player, its impact could be more far reaching, applying to all seasonal workers, including teachers, resort workers and lifeguards. The rule of law exposed in Raybon v. DP Fox Football Holdings, LLC, stands to show no seasonal employee should receive wage loss benefits in the off-season, when the absence of wage loss is related to season ending employment rather than a work-related disability.
